No tax on tips: who qualifies and how to claim it
Published
Work out your own numbers with the no tax on tips calculator.
The 2025 tax law lets workers who earn tips deduct up to $25,000 of them from federal taxable income. The deduction is for tax years 2025 through 2028. It is claimed on Schedule 1-A of Form 1040, so you get it whether you take the standard deduction or itemize.
Who qualifies
You can take the deduction if all of these are true:
- You work in a job that the Treasury lists as one where people customarily got tips before 2025. The list includes restaurant servers, bartenders, hair stylists, delivery drivers, hotel staff and many more.
- The tips were paid voluntarily by the customer. Mandatory service charges and automatic gratuities do not count.
- The tips are reported to the IRS, on your Form W-2, a Form 1099, or Form 4137 for tips you did not report to your employer.
- You have a valid Social Security number, and you include it on the return.
- If you are married, you file a joint return. Married people who file separately cannot take the deduction.
Self-employed people can also claim it, but not if the business is a specified service trade or business, such as health, law, or performing arts.
How much you can deduct
The cap is $25,000 per return. If your tips are lower, you deduct the amount of your tips.
The cap goes down by $100 for each full $1,000 of modified adjusted gross income (MAGI) above $150,000, or $300,000 on a joint return. At $200,000 of MAGI, a single filer loses $5,000 of the cap and can deduct up to $20,000.
| MAGI (single) | Largest deduction |
|---|---|
| $150,000 or less | $25,000 |
| $175,000 | $22,500 |
| $200,000 | $20,000 |
| $300,000 | $10,000 |
| $400,000 or more | $0 |
What it does not change
The deduction lowers federal income tax only. Tips are still subject to Social Security and Medicare tax. States decide for themselves whether to follow the federal rule, so your state return may still tax your tips.
A deduction is not a credit. It lowers the income that is taxed, so the money you save depends on your tax bracket. A server in the 12% bracket who deducts $10,000 of tips saves about $1,200.
How to claim it
- Collect your W-2 and any 1099 forms. Box 7 of the W-2 shows Social Security tips, and employers must report qualified tips separately.
- Add any cash tips you did not report to your employer on Form 4137.
- Fill in the tips section of Schedule 1-A and carry the total to Form 1040.
Keep your daily tip records. If the IRS asks, you need to show the amount and that the tips were voluntary.
Common questions
Is no tax on tips permanent?
No. The deduction applies to tax years 2025, 2026, 2027 and 2028. It ends after 2028 unless Congress extends it.
Do I need to itemize to deduct my tips?
No. The deduction is taken on Schedule 1-A and reduces taxable income even if you take the standard deduction.
Are tips still subject to Social Security tax?
Yes. Social Security and Medicare tax still apply to all tips. Only federal income tax is reduced.
Can I claim the tips deduction if I am married filing separately?
No. Married taxpayers must file a joint return to take the deduction.
Do automatic gratuities count as tips?
No. A charge that the customer must pay, such as an automatic 18% added for a large party, is a service charge, not a tip. Only voluntary tips qualify.
